You can ask us to do various things with your personal information. For example, at any time you can ask us for a copy of your personal information, ask us to correct mistakes, change the way we use your information, or even limit its processing or rectify it. We’ll either do what you’ve asked, or explain why we are unable to - usually because of a legal or regulatory competing obligation.
You can make any of the requests set out below using the contact details provided to you in your documentation or below.
For further details about your rights please see below.
You have the following rights in relation to our use of your personal information.
The right to access your personal information
You are entitled to a copy of the personal information we hold about you and certain details of how we use it. There will not usually be a charge for dealing with these requests. Your personal information will usually be provided to you electronically where possible. Where not possible, or where otherwise agreed, we will provide your personal information in writing or other suitable formats available.
The right to rectification
We take reasonable steps to ensure that the personal information we hold about you is accurate and, to the extent necessary, complete. However, if you do not believe this is the case, please contact us by using the details shown in your documentation and you can ask us to update or amend it.
The right to erasure
Under specific circumstances, you may have the right to ask us to erase your personal information. However, this will need to be balanced against other factors relevant to the type of personal information we hold about you and why we have collected it. There may be some legal and regulatory reason which means we cannot comply fully with your request.
Right to restriction of processing
In certain circumstances, you are entitled to ask us to suspend using your personal information for a period, for example where you think that the personal information we hold about you may be inaccurate, to allow us to verify the accuracy, or where you think that we no longer need to process your personal information, but we need to keep it for legal reasons.
Right to data portability (Quebec)
In certain circumstances, you have the right to ask that we transfer any personal information that you have provided to us to another third party (e.g. another assistance provider) of your choice. Once transferred, the other party will be responsible for looking after your personal information.
Rights relating to automated-decision making
You have the right to ask if your personal data is used as part of automated processing, including profiling, which produces legal effects of similarly significant effect.
We do not currently conduct any automated-decision making that falls under the scope of this right.
The right to withdraw consent
For certain uses of your personal information, we will ask for your consent. Where we do this, you have the right to withdraw your consent at any time. Please note in some cases we may not be able to provide you with a service or claim if you withdraw your consent.
The right to lodge a complaint
You have a right to complain to the relevant supervisory authorities at any time if you believe that we have not met the requirements of data protection law. Canada’s Office of the Privacy Commissioner will usually expect that you have given us the opportunity to resolve your complaint before they will take up your inquiry, so please do tell us first if you think we have not complied with these laws. More information can be found on their websites or by contacting the authority – contact details provided below in the “Contact details of the Data Protection Officer” section.
In some circumstances exercising some of these rights will mean we are unable to continue providing you with services. This may therefore result in the cancellation of a service or claim. You may also lose the ability to bring any claim or receive any benefit or service including in relation to any event that occurred before you exercised your right. Your policy terms and conditions set out what will happen should this happen.
